MEAD “FIVE STAR® MUSIC INSIDER” SWEEPSTAKES OFFICIAL RULES
1. NO PURCHASE NECESSARY. A purchase will not increase your chances of winning. All Entrants must, at time of entry, be a legal resident, currently residing within the 50 United States (including D.C.), 13 years of age or older (18 years of age or older in Maine) and must have Internet access as of 6/1/10. Void where prohibited. Between 12:00:01 p.m. ET on 6/1/10 and 11:59:59 a.m. ET on 9/30/10 (“Promotional Period”), visit www.FiveStarMusicInsider.com or www.FiveStarMusicInsider.com/target and follow the instructions to register and vote for your favorite band. You will automatically receive one (1) entry when you vote for your favorite band. Each vote must be cast and received by 11:59:59 a.m. ET each day during the Promotion Period in order to receive an entry for that day. A “day” is defined as the twenty-four hour period starting at 12:00:01 p.m. ET on a specific calendar day and ending at 11:59:59 a.m. ET the following calendar day. Limit one (1) entry per person, per day. Each person may only use one (1) email address to participate in this promotion, and such email address may only be used by one person regardless of whether the email address is shared by two or more people. Any participant who uses more than one (1) email address to enter this promotion may be disqualified and any prizes won may be forfeited subject to Sponsor’s sole discretion. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized Account Holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. All entries become the exclusive property of Sponsor and will not be returned or acknowledged. Sponsor is not responsible for incomplete, lost, late, misdirected or incomplete transmission defaults; computer server failure; phone failure; and/or delayed, garbled or corrupted data. Sweepstakes begins 12:00:01 p.m. ET on 6/1/10 and ends 11:59:59 a.m. ET on 9/30/10.
2. PRIZES/ODDS: GRAND PRIZE (1): Grand Prize winner will receive $25,000. Monetary amounts will be awarded in the form of a check made payable to the Grand Prize winner, or, if the winner is a minor in his/her state of residence, the Grand Prize will be awarded to his/her parent or legal guardian. Grand Prize winner will be issued a Form 1099, as required by the Internal Revenue Service. (Approximate Retail Value (ARV) of Grand Prize: $25,000.00). FIRST PRIZES (100): Each First Prize winner will receive one (1) iPod® Shuffle (ARV: $80 each; Total ARV of all First Prizes $8,000.00). Sponsor makes no warranty with respect to any prize. No transfer, assignment or substitution of any prize is permitted, except by Sponsor. The cash equivalent of any “noncash” prize is not permitted, except at Sponsor’s sole discretion. All taxes are the sole responsibility of each winner. Sponsor will report value of prize as required by law. Any difference between Approximate Retail Value and Actual Value of Prize will not be awarded. TOTAL ARV OF ALL PRIZES IS $33,000.00. Prizes will be awarded at the end of the Promotional Period. Odds of winning a prize depend on the number of eligible entries received. Limit one (1) prize per person, household or address.
3. DRAWING: Potential prizewinners will be randomly selected on or about 10/14/10 from among all valid entries received by an independent judging agency whose decisions are final. Each potential prizewinner will be notified at the mailing address provided at the time of registration. If potential winner does not respond within the time allotted on the prize notification letter, potential winner will be disqualified and the prize forfeited. In the event of a potential winner’s disqualification for any reason, Sponsor will award the corresponding prize to an alternate potential winner in a random drawing from among the remaining eligible entries received. Please allow 6 to 8 weeks for shipment of the prizes after winner verification and all documentation has been completed and returned. If prize is returned undelivered, prize will be forfeited and an alternate winner will be selected from the remaining nonwinning eligible entries. All prizes will be awarded assuming the number of eligible entries is equal to or greater than the number of prizes available.
4. ELIGIBILITY: NO PURCHASE NECESSARY. Sweepstakes is open to all legal U.S. residents currently residing within the 50 U.S. (including D.C.) who are 13 years of age or older (18 years of age or older in Maine) at the time of entry and who have Internet access as of 6/1/10. Employees (and household family members of such employees) of Sponsor, VerveLife, and their advertising, promotion and fulfillment agencies and their affiliates are not eligible. Further, the individual band members selected for voting in this Sweepstakes are not eligible. Void where prohibited or otherwise restricted by law. All federal, state and local laws and regulations apply. Grand Prize winner will be required to complete and return an Affidavit of Eligibility/Publicity Release. Each First Prize winner will be required to complete an Address Confirmation letter. All required documentation, including, the Affidavit of Eligibility/Publicity Release and Address Confirmation must be returned within fourteen (14) days as provided in the prize notification letter or the prize will be forfeited and an alternate potential winner will be randomly selected. By entering this Sweepstakes, each winner consents to the use of his/her name, photographs, voice recordings and likenesses for publicity purposes by Sponsor without additional compensation or permission, where permitted by law. In the event that the prizewinner is a minor in his/her state of residence and the prize is awarded to his/her parent or legal guardian, a separate publicity release will be required to be completed for the minor, where permitted by law.
5. GENERAL: By entering this Sweepstakes, entrants accept and agree to be bound by these full Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters. MeadWestvaco Consumer & Office Products (“Sponsor”) reserves the right to suspend or cancel this Sweepstakes without notice in the Sponsor’s sole and absolute discretion if the promotion is not capable of running as planned, or if tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion. Sponsor reserves the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend the promotion, or any portion thereof, without obligation. Any attempts by an individual to access the site via a bot script or other brute-force attack will result in that IP address becoming ineligible. Sponsor’s failure to enforce any term of these full Official Rules shall not constitute a waiver of that provision. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE GAME. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. In the event that the Sweepstakes is suspended or terminated, notice will be posted on the Web site. In the event of early termination and as provided by the early termination provision, prize drawings will take place from amongst all eligible entries received prior to the Sweepstakes termination.
6. RELEASE OF LIABILITY: All entrants by entering agree that (a) Sponsor, VerveLife, and the bands and each of their parents, affiliates, subsidiaries, and the officers, directors, agents, employees of each and all others associated with the development, administration, execution, fulfillment or advertising/promotion of this Sweepstakes are hereby released from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of any prize, including liability for personal injury, bodily injury, death, damages or loss; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, will be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award will be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
